Federal Judge Mandates Release of Kilmar Abrego Garcia from ICE Detention

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without legal authority.

"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The situation stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer human smuggling charges, he was held in federal custody.

In her order, the judge pointed out that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
